| It has emerged that Sergi Xavier MM (21), who is awaiting trial for a violent racist attack on an Ecuadorian girl on a local train in Barcelona last October that was caught on cctv camera, has already been convicted after being caught riding a moped under the influence of alcohol last Friday.
Sergi was stopped shortly before 8pm after regional police spotted him failing to slow down on the approach to a roundabout. He was then arrested after testing over the limit for alcohol having voluntarily submitted to a breathalyser test.
With previous convictions for robbery with violence, he has had his licence withdrawn for ten months, has been sentenced to serve 40 days' community service and fined €1,080 euros.

Judge Eduardo Gómez López released racist thug, Sergi Xavier (21), who was caught on cctv attacking a 16 year old Ecuadorian girl on a train in Barcelona, following a court hearing yesterday.
The man, who claims he was drunk and cannot remember punching, kicking, insulting and threatening the girl on the 7th October, has been banned from using the S-8 local train service on which the attack took place, and from coming within 1,000 metres of his victim. He will also have to report to the police twice a day and present himself in court once a fortnight while the matter is investigated further.
The victim, who is being treated for stress and depression since the attack and who says she is now too frightened to go out, is being supported by the Ecuadorian government which has hired lawyers to help her.
In his ruling, the judge described the attack as "repugnant," but did not merit remanding the man in custody as prosecutors and the victim's lawyers had demanded.
Around 250 people gathered in Barcelona city centre yesterday evening to condemn racism and express their support for the victim.

A 21 year old Spanish man has been arrested for a racist attack committed against a 16 year old Ecuadorian girl that was caught on a cctv camera installed in the train carriage where the incident occurred on the 7th October.
The shocking footage shows the man repeatedly kicking and punching the terrified teenager, who told police that she had also been insulted on racial grounds and told that she would be killed.
The assault, which happened on a train travelling from the Plaza de España to Martorell, continued until the girl got off at Sant Vicenç dels Horts station, where she called 112 and was later found by police and emergency service medics in a state of shock, but relatively unscathed. However, she has since been too frightened to go out.
The yob responsible, who has previous robbery with violence convictions, was arrested outside his home in Santa Coloma de Cervelló last Friday.
The footage shows that there was a third individual in the carriage while the assault was taking place; a young South American youth too terrified to intervene for fear of the almost inevitable consequences. |
