| The Spanish Supreme Tribunal has upheld the ruling passed in 2002 by a judge at Girona provincial court and ordered Citroen Hispania SA to pay €128,000 euros in compensation to the driver of a ZX for the permanent injuries sustained in a head-on collision on May 12th, 1998.
Citroen had argued that the amount due should be reduced because the serious injuries suffered were mainly the result of the victim's own bad driving and the fact that he had not been wearing his seatbelt.
Notwithstanding, based on evidence presented by experts from Volvo, the court was told that, had the car's airbag deployed properly, the driver's injuries would have been 40% less severe. |
