Miguel Carcaño sentenced to 20 years for the murder of Marta del Castillo
Miguel Carcaño has today been sentenced to 20 years in prison for the murder of Marta del Castillo, but was cleared by the court in Seville of raping her. His three alleged accomplices were cleared of all charges.
Carcaño has also been ordered to pay 140,000 euros compensation each to the parents of Marta del Castillo and 30,000 to each of her two sisters, but he was not ordered to pay the 616,319 euros spent on searching for the body as it was considered "a necessary part of the investigation of the crime" and "the police's obligation".
Carcaño's brother, Francisco Javier Delgado, and his girlfriend, María García, and his friend Samuel Benítez were all cleared of aiding and abetting in the disposal of the victim's body.
The jury decided that it could not be proven that Carcaño and 'el Cuco', the minor already tried in the case, raped Marta. It was established that Marta died from a single blow to the left side of her head with a "big, heavy, glass ashtray" and that Carcaño and 'el Cuco', together with a third, unidentified person, disposed of the body in an unknown location.
'El Cuco' was previously cleared of rape and murder in a juvenile court and is currently serving a two year and 11 month sentence for covering up for Carcaño.
The judges cleared Samuel Benítez, Carcaño's friend, who had been facing an eight-year sentence, believing claims that he spent the whole night in question in Montequinto de Dos Hermanas (Seville) and because "there was not a shred of evidence to corroborate" Carcaño's implication of him in the crime.
Carcaño's brother, Francisco Javier Delgado, was also cleared as "witness statements and the localisation of mobile 'phone calls prove where he was at every point through the night and corroborate his own statement".
Carcaño was also cleared of violating the moral integrity of Marta's parents by not revealing the wherabouts of their daughter's corpse as it was proven that he did not do so to "offend, degrade or humiliate" them, but rather to conceal evidence that could be used against him.
