THE wife of Diana Quer's self-confessed killer has been released from investigations as latest data shows she was not involved with the murder of the sixth-former from Pozuelo de Alarcón (Madrid), whose body was found in a well in a disused warehouse in Rianxo (A Coruña province, Galicia).
Rosario Rodríguez, 29, was initially charged with aiding and abetting for attempting to cover up the crime, having claimed her husband, José Enrique Abuín Gey, 41, had been with her all night on August 21 and 22, 2016.
She said they had been looking for a lorry to steal petrol from to fuel their car, a grey Alfa Romeo family saloon, as they were living hand-to-mouth.
But on December 30, 2017, she cracked under pressure and admitted Abuín Gey had been out all night and she had gone to bed.
Her brother and sister-in-law, who lived with the couple at the time, said Rosario had been at home when Diana Quer disappeared whilst walking back from the local fiestas to her family holiday home in A Pobra do Caramiñal, about 20 kilometres from where her body was found on New Year's Eve.
And police have tracked Rosario's mobile phone, which showed she was at home when the 18-year-old student and professional model disappeared.
Rosario's father says he believes his daughter felt threatened and had automatically lied for her husband, whom she married when she was just 16 years old.
The family has never had a good relationship with Abuín Gey since Rosario's twin sister accused him of raping her at knifepoint when she was aged 16 or 17 – something she stands by to this day and police suspect is very likely to be true.
They are considering reopening the case, since it was 12 years ago and has not yet expired.
Abuín Gey, known as 'El Chicle' ('Chewing Gum') because of a speech impediment in childhood which made him sound as though his teeth were stuck together, has been moved from Teixeiro to A Lama prison to protect him from possible reprisal from fellow inmates.
The results of Diana Quer's post-mortem have not yet been released, but a preliminary report has ruled out El Chicle's initial claims that he accidentall ran her over, and hints she may have been raped.
El Chicle's defence lawyer says he will resign from the case if it turns out Diana was sexually assaulted.
