To reserve the property, an initial payment of one month's rent as a security deposit is required (refundable within the legally established timeframe, after the property has been handed over to the owner, provided it is in the same condition as when it was handed over to the tenant and the terms of the rental agreement are met). Law 12/2023, of May 24, on the right to housing, was approved by the Congress on April 27, 2023, and by the Senate on May 18, 2023. It entered into force the day after its publication in the Official State Gazette (BOE), on May 26, 2023. Article 20, section 1, establishes that real estate management fees and contract formalization costs are the responsibility of the landlord.

This regulation DOES NOT APPLY to lease agreements for uses other than housing, such as commercial premises, nor to seasonal lease agreements. In these cases, the tenant is responsible for paying the agency fees, along with the corresponding IGIC (Canary Islands General Indirect Tax).
